Grievance & Legal

1. GRIEVANCE REDRESSAL FRAMEWORK

  • The Patron-First Protocol: Yutiqaa is committed to resolving all concerns with grace, befitting a luxury house. All grievances must first be directed to our Concierge at care@yutiqaa.com.
  • Grievance Officer: In accordance with the Information Technology Act and rules made thereunder, the contact details of the Grievance Officer are:

  • Resolution Timeline: We acknowledge all formal grievances within 24 hours. A definitive resolution or status update will be provided within 15 business days.

2. LIMITATION OF LIABILITY

  • Masterpiece Disclaimer: To the maximum extent permitted by applicable law, Yutiqaa’s total liability for any claim arising out of or relating to the purchase of a masterpiece shall be limited to the actual amount paid by the Patron for said product.
  • Exclusion of Damages: Yutiqaa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of prestige, emotional distress, or loss of perceived value.

3. INDEMNIFICATION

Patron Responsibility: The Patron agrees to indemnify and hold harmless Yutiqaa Lifestyle Private Limited from any claims, damages, or legal fees arising from the Patron’s breach of the IP Policy, misuse of the digital platform, or violation of third-party rights.

4. CONFLICT RESOLUTION & DISPUTE ESCALATION

  • Step 1: Internal Resolution: All disputes, differences, or controversies shall first be attempted to be resolved amicably through direct negotiation between Yutiqaa and the Patron.
  • Step 2: Legal Recourse: If a resolution is not reached through internal negotiation within 30 days, the dispute shall be referred to the courts of law as specified in Section 5.

5. GOVERNING LAW & JURISDICTION

  • Governing Law: This policy and all legal engagements with Yutiqaa are governed by and construed in accordance with the Laws of India.
  • Exclusive Jurisdiction: As established in our Terms & Conditions, any legal proceedings arising out of or in connection with Yutiqaa shall be subject to the exclusive jurisdiction of the courts in Odisha, India.

6. GLOBAL CLASS ACTION WAIVER

Individual Resolution: To the extent permitted by law, the Patron agrees that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

7. FORCE MAJEURE

Acts of Heritage Protection: Yutiqaa shall not be held liable for delays or failures in performance resulting from “Acts of God” or events beyond our reasonable control, including but not limited to natural disasters affecting artisan clusters, pandemics, or sudden shifts in international export regulations.
